2009 Results

In 2009, on the first day of trial, Engel & Schultz obtained a settlement of $3,000,000 on behalf of a limited partner, whom the partnership claimed had failed to pay for his partnership units.  The case settled immediately after Engel & Schultz won two “limine” motions, one of which prevented the partnership from presenting one of its theories of the case, and the other of which allowed the limited partner to present evidence which the partnership had sought to exclude.  Prior to trial, Engel & Schultz had successfully defeated a motion to dismiss the case as time barred, as the date of purchase of the partnership units in dispute was fifteen years prior to the date of the filing of the Complaint in court.

In 2009, the firm also obtained a settlement in a disability action on behalf of a client who had been terminated, rather than accommodated, as the result of a back injury which had resulted from a fall from a ladder at the employee’s place of employment.
