Tisbury Fuel
Service Inc. v. Martha's Vineyard Commission, Dukes County Superior Court
The
firm represents Tisbury Fuel Service, Inc., which wishes to open a service
station which would sell "discounted" gasoline on Martha's
Vineyard. The number of gas stations on the Vineyard had declined steadily
since 1970, and Tisbury Fuel Service proposed opening a new station which
would sell gasoline at considerably lower prices than the prices being
offered at the island's other gas stations. The Martha's Vineyard Commission
rejected Tisbury Fuel Service's application, despite evidence showing there would
be minimal impact on traffic and a considerable economic benefit from the
building of a gas station dedicated to selling named brand gasoline at a
lower price. Engel & Schultz appealed the Commission's decision to court
where a six day trial was held challenging the Commission's decision. The
